ARTICLE 6 – RIGHT OF WITHDRAWAL ON THE SITE OGASAKA-EUROPE.COM

Right of withdrawal, returns and money back guarantee. The site OGASAKA-EUROPE.COM respects the commitment “Satisfied or Refunded” of the quality charter of the Federation of Distance Selling Companies (FEVAD). You have 14 days from the day after receiving the items to make up your mind. The withdrawal period begins to run on the day after the contract is concluded or the goods are delivered. If this period expires on a Saturday, Sunday or holiday, it is extended to the first business day. In the case of the purchase of several goods delivered over several periods, the right of withdrawal applies from the day after receipt of the first good. Within the framework of the purchase of a good and an associated service, the right of withdrawal applies as from the day after the reception of the ordered good. In the event that the product received does not correspond to that ordered by the buyer, the latter has a period of fourteen (14) days upon receipt of the package to request the return of the Customer Service. However, it is not possible to change the purchased item for another one. All products are provided with an identification label attached with a chain or plastic tie. The buyer agrees not to remove the label and its attachment from the products purchased and returned. Any damage to the material resulting from inadequate packaging does not engage the responsibility of the company ONI ONE. Products returned with postage due will be systematically refused. Please note that if the product is declared to be in conformity with the displayed characteristics but you are not satisfied with it, the return costs of the purchased products remain at the buyer’s charge. However, if the product is found not to conform to the expected characteristics, you will return it to us at our expense. To summarize, in case of exercising the right of withdrawal, the return of products is considered valid if and only if: – The return form is correctly filled in and received by The Site; – The product returned within 14 days after the sending of the retraction; – The product is in its original packaging, with its label; – The article has not been degraded, worn, stained, washed. In the case of an online withdrawal form, the Site will provide a confirmation of receipt. Refund following withdrawal Important : The site OGASAKA-EUROPE.COMIn case of exercise of the right of withdrawal of the buyer, may not accept the return of products that do not meet the conditions summarized above. In this case, the refund of the returned items would not be accepted and the possible expenses of return of the products will remain with the load of the purchaser. However, if the buyer so requests, he may obtain the products again, at his own expense, in the state in which they were returned. In the absence of such a request, OGASAKA-EUROPE.COM will be able to keep the products, in addition to the amounts already paid for their acquisition. The site OGASAKA-EUROPE.COM will reimburse the total amount paid, including delivery costs, within fourteen (14) days of receipt of the cancellation request, unless there is a justified delay. However, in case of return of a part of the order, OGASAKA-EUROPE.COM will reimburse the delivery costs in proportion to the number of items returned, except in the case of flat-rate delivery costs. However, for a sale of goods, OGASAKA-EUROPE.COM may defer reimbursement until the day the goods are recovered or until you provide proof of shipment of the goods. Please note that you must return the product and the service supplies will be terminated. A discount proportional to the duration of the service consumed may be applied in the case of a withdrawal from a service. The seller will reimburse you by the same means of payment as for the purchase unless the consumer has given his express agreement for a reimbursement in the form of a credit note or voucher. The use of gift certificates makes it impossible to reimburse them in cash. A purchase paid by credit or voucher can only be refunded in this form. In case of delay in reimbursement, surcharges may be applied according to the legal rate. The consumer who would not manage to assert his right of withdrawal has the possibility of putting in residence the salesman for refunding of the versed sums. Exclusion of support for returns on personalized products OGASAKA-EUROPE.COM applies a legal clause of exclusion of return on the products known as personalized to your request. Customized products are any product for which an action is necessary to adapt to the customer’s request and which irrevocably transforms the product so that it no longer conforms to the original. The installation of the binding implies the drilling of the skis which constitutes an irreversible modification of the product. A ski pierced is therefore considered a custom product and ONI ONE will not be required to accept a return and exercise the right of withdrawal. Use and responsibilities In all the cases, ONI ONE could not be held for person in charge for not respect of the regulatory and legislative provisions in force in the country of reception, the responsibility for ONI ONE is systematically limited to the value of the product put in question, value at its date of sale and this without possibility of recourse towards the mark or the company producing the product OGASAKA-EUROPE.COM and the brands distributed on the platform cannot be held responsible for damages of any kind, whether material or immaterial or physical, which could result from a malfunction or misuse of the products marketed. The same applies to any changes in the products resulting from the manufacturers. The responsibility of OGASAKA-EUROPE.COM and ONI ONE will be, in any event, limited to the amount of the order and can not be held responsible for simple errors or omissions that could remain despite all precautions taken in the presentation of products. After-sales service After the intervention of the after-sales service, the return of goods to the customer is made at our expense. If it turns out that the returned material has not been the subject of a return authorization and/or that it is not affected by a defect within the framework of the guarantee, it will be returned to the customer with postage due. In order for your return request to be accepted, three conditions must be met: – Make a written request for return to the after-sales service; after acceptance, send us the product for which a manufacturing defect is found and mention the return number;- The product(s) must be received by our services within 30 days after delivery. Legal warranty The products sold by OGASAKA-EUROPE.COM are covered by the legal guarantee on hidden defects and faults, as defined in Articles 1641 and following of the French Civil Code. In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). Provided that the Buyer proves the hidden defect, ONI ONE undertakes to repair all the consequences, in accordance with Article.1641 and following of the Civil Code. The articles relating to guarantees are included in Article 10 of these General Terms and Conditions of Sale. If the buyer goes to court, he must do so within a “short period of time” from the discovery of the hidden defect (art.1648 of the Civil Code). The goods marketed by OGASAKA-EUROPE.COM are covered by a contractual warranty of one year from the date of purchase under the commercial warranty. This warranty is extended to one (1) year. This is a free guarantee. It covers “parts and labor” and can lead to: replacement of all or part of the product or even its reimbursement to see on a case by case basis. The goods marketed by OGASAKA-EUROPE.COM can be covered by an extended warranty. This option is optional and concerns the replacement of the vehicle. No warranty extension is imposed or included: It is up to the buyer to check a corresponding box. By taking this action, you explicitly agree to adhere to a paid warranty. In case of immobilization of the good the legal guarantee is suspended so that for one week of immobilization, the guarantee coverage will be extended by one week. Exclusions from the guarantee The legal guarantee does not cover breakage during transport or wear and tear caused by normal use for which the product was designed. The guarantee does not cover deterioration caused by insufficient snow cover or risky skiing conditions (e.g. torn edges, sinking of the edges). If both skis are broken, only one will be replaced free of charge, the other will be charged. The user is responsible for the shipping costs. Unless otherwise stated on the product sheet, batteries are not covered by warranty. Case of products that are not or no longer covered by the warranty. Please contact directly the Customer Service of OGASAKA-EUROPE.COM. A repair fee may apply. The Customer will be informed in writing in an estimate including the price and the time of intervention. For lump sums, the estimate will include information on the origin of the breakdown, the nature of the intervention, the parts and supplies replaced, the description of the service.
